Introduction

These Terms of Service (“Terms”) govern your access to and use of the online store at get.flytstikr.com and the purchase of vinyl graphics, vinyl stickers, and related products (collectively, “Products”). By creating an account, placing an order, or using the site you agree to these Terms and any policies incorporated by reference.

Incorporated policies

The following policies are part of these Terms: our Sales & Refunds Policy, Privacy Policy, and any other posted policies. If a conflict exists, these Terms control unless the policy expressly states otherwise.

Eligibility and accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to place orders.

  • You are responsible for maintaining account security and for all activity under your account. Notify us immediately of unauthorized use.

Orders, pricing & payment

  • All orders are subject to acceptance and availability. We may refuse or cancel orders for any reason (including errors in pricing or product description).

  • Prices shown do not include taxes, duties, or shipping charges unless stated. You are responsible for applicable taxes and import fees.

  • Payment is due at the time of purchase. We accept the payment methods displayed at checkout. By submitting payment, you represent you are authorized to use the chosen payment method.

Product descriptions & limitations

  • We try to ensure product images and descriptions are accurate; however, actual colors, textures, and scale may vary. Vinyl materials and finishes may show slight variations.

  • Custom products: If you order custom graphics, you warrant you own or have rights to all supplied artwork and that it does not infringe third‑party rights. We may refuse any custom design at our discretion.

Intellectual property

  • All site content, branding, product images, and text are owned or licensed by us. You may not reproduce, distribute, or create derivative works from our content without written permission.

  • When you submit artwork for printing, you grant us a non‑exclusive, revocable license to use that artwork solely to fulfill your order, provide customer service, and for quality control. We do not claim ownership of your submitted artwork.

Returns, refunds & cancellations

  • Returns, refunds, and cancellation rules are governed by our Sales & Refunds Policy (incorporated by reference). For custom or made‑to‑order items, different rules may apply (see the Sales & Refunds Policy).

Shipping & delivery

  • Shipping times are estimates. We are not liable for delays caused by carriers, customs, or force majeure events. Loss or damage claims must be made in accordance with our Shipping Policy.

Warranties & disclaimers

  • Our products are made to order to your specifications. Except as expressly stated in writing or in a product‑specific warranty, we supply made‑to‑order products without other warranties and do not warrant that a product will be free from minor variations in color, texture, or finish inherent to custom production.

  • To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

  • Where applicable law does not permit exclusion or limitation of implied warranties, those warranties will apply only to the minimum extent required by law.

Limitation of liability

  • To the maximum extent permitted by law, our total liability arising from or related to these Terms or the Products will not exceed the amount you paid for the specific order giving rise to the claim.

  • We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or loss of business.

Indemnification

You agree to indemnify and hold harmless FlytStikr, its officers, employees and agents from claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms; (b) your misuse of Products; (c) your submitted custom artwork that infringes third‑party rights.

Prohibited uses

You must not use the site or Products for illegal activities, to infringe others’ rights, to produce unlawful material, or to create counterfeit goods. We may suspend or terminate accounts suspected of prohibited use.

Modifications to products, prices & Terms

We may change product offerings, prices, and these Terms at any time. Material changes to these Terms will be posted with a new “Last updated” date. Continued use after notice constitutes acceptance. For existing orders, the Terms in effect at purchase apply.

Dispute resolution & governing law

  • These Terms are governed by the laws of Illinois, USA, without regard to conflict of law rules.

  • For consumers: where required by law, you retain any non‑waivable rights under local consumer protection laws.

  • Optional: include arbitration clause or forum selection if you wish to require arbitration or specify courts; consult counsel before adding.

Termination

We may suspend or terminate access to the site or your account for violations of these Terms or for business reasons. Termination does not relieve you of outstanding payment obligations or sections that by their nature survive termination.

Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.

Entire agreement

These Terms, together with incorporated policies and any order confirmations, constitute the entire agreement between you and us regarding your use of the site and purchases.
